This website is operated by African ART.site. Throughout the website, the terms "we", "us" and "our" refer to African ART.site.

By visiting our website, placing an order, submitting an enquiry, or using any service available through this website, you agree to these Terms of Service and to any policies referred to in them, including our Returns and Refunds Policy, Shipping Policy and Privacy Policy.

Please read these terms before using the website or placing an order. If you do not agree to them, you should not use the website or purchase from us.

Nothing in these terms excludes or limits any right or remedy that cannot lawfully be excluded under applicable consumer law.

3. Online Store Use

You may use this website only for lawful purposes.

You must not:

  • Attempt to interfere with the website's security or operation.
  • Submit false, misleading or fraudulent information.
  • Place an order using payment details you are not authorised to use.
  • Copy, reproduce or commercially exploit our website content, product designs, photographs, text or branding without written permission.

We may refuse service, cancel an order, or restrict website access where reasonably necessary to prevent fraud, abuse, unlawful activity or harm.

4. Product Information

We aim to display product descriptions, dimensions, materials, photographs, wood options, prices and availability accurately. Screen settings, lighting and natural material variation may affect how colours and textures appear.

Natural wood veneer varies in grain, tone, colour and pattern. These natural variations form part of the character of the material and are not defects.

Customers must review the selected product, dimensions, wood option, quantity, mounting requirements and other specifications before placing an order. Please contact us before ordering if you need help confirming suitability for your space.

Wine bottles, decor objects and other styling props shown in product photographs are not included unless the product page expressly states otherwise.

5. Prices and Payment

Prices are displayed in South African rand unless otherwise stated. Applicable tax is included where indicated.

The price charged is the price displayed at checkout when the order is placed, subject to correction of an obvious pricing or technical error. We may change prices at any time, but changes will not affect an order already accepted unless the displayed price was clearly incorrect.

Payment must be completed using an available payment method at checkout. An order is not confirmed merely because an attempted payment or order submission was received.

6. Orders and Acceptance

After an order is submitted, you may receive an automated acknowledgement. This confirms receipt of the order but does not necessarily mean that the order has been accepted.

We may contact you to verify product selections, delivery information, payment, quantities or custom requirements. We may decline or cancel an order where:

  • Payment is not authorised or appears fraudulent.
  • A product, material or selected option is unavailable.
  • The delivery address cannot reasonably be served.
  • The website contained an obvious pricing, stock or product-information error.
  • The order cannot be completed lawfully or safely.

If we cancel an order after receiving payment, we will refund the amount paid using the original payment method, subject to applicable law.

7. Made-to-Order Products

Most African ART.site products are made to order in the wood option selected by the customer. Standard production usually requires 2 to 4 weeks before dispatch unless the product is already in stock or a different period is agreed.

Lead times are estimates and may be affected by material availability, order volume, production requirements, public holidays, courier delays or events outside our reasonable control. We will communicate material delays where reasonably possible.

Once materials have been allocated or production has begun, an order may not be eligible for change, cancellation or a voluntary change-of-mind return. This does not affect rights relating to defective, unsafe, damaged or incorrectly supplied goods.

8. Custom, Bulk and Commercial Orders

Custom sizes, design changes, special finishes, bulk quantities, commercial projects and export orders require written confirmation or a quotation.

The customer is responsible for reviewing and approving all relevant dimensions, quantities, wood selections, finishes, drawings, specifications, prices and delivery information before production begins.

Orders containing three or more units, specially customised products, and approved commercial, wholesale, hospitality or project orders are final sale once approved and production has begun, except where a product is defective, unsafe, materially different from the approved specification, or a remedy is required by law.

9. Delivery

We currently offer free nationwide delivery on products purchased through the South African online store, unless a product page, quotation or checkout states otherwise.

Customers must provide a complete and accurate delivery address, contact number and any access information needed for delivery. Additional costs caused by an incorrect address, failed delivery, restricted access, special handling or redelivery may be charged where reasonable and lawful.

Delivery dates are estimates and are not guaranteed unless expressly agreed in writing.

Risk of accidental loss or damage passes in accordance with applicable law. Please inspect the parcel and product promptly after delivery. Courier-related damage should be reported to info@africanart.site as soon as possible, preferably within 48 hours, with photographs of the product, packaging and shipping label. This reporting request does not limit statutory rights.

Export delivery is available only by prior arrangement. International customers may be responsible for shipping, insurance, duties, taxes, customs charges, import requirements and local delivery costs as stated in the approved quotation.

10. Installation and Product Use

Customers are responsible for confirming that walls, mounting surfaces, fittings and installation methods are suitable for the product and intended load.

Installation hardware is supplied only where stated on the product page. If you are uncertain about installation, use a suitably qualified installer.

We are not responsible for damage caused by incorrect installation, unsuitable walls or fixings, misuse, unauthorised modification, failure to follow product guidance, or use outside the product's intended purpose, except to the extent that responsibility cannot lawfully be excluded.

11. Returns, Refunds and Cancellations

Returns, refunds, exchanges, damaged products and order cancellations are governed by our Returns and Refunds Policy.

Eligible small standard orders may be submitted for return consideration within 30 calendar days after delivery, subject to the requirements in that policy. Custom, bulk, commercial and specially approved orders have different conditions because materials and production capacity are committed specifically to them.

Do not send a product back before receiving written return approval and return instructions from us.

Nothing in these terms or our Returns and Refunds Policy limits rights relating to defective, unsafe, damaged, incorrectly supplied or materially misdescribed goods.

12. Website Information and Availability

We may update, suspend or discontinue any part of the website, product range or service without notice. We do not guarantee that the website will always be uninterrupted, secure or error-free.

We may correct errors or omissions in product information, pricing, promotions, availability or other website content. Where a correction materially affects an accepted order, we will contact the customer and provide an appropriate option in accordance with applicable law.

13. Third-Party Services

Our store may use or link to services provided by Shopify, payment providers, couriers, Google, social-media platforms and other third parties.

Third-party services and websites are governed by their own terms and privacy practices. We are not responsible for third-party content or services outside our reasonable control, but this does not limit any responsibility we have under applicable law for services used to fulfil your order.

14. Intellectual Property

The African ART.site name, branding, website content, product photographs, product descriptions, graphics and original product designs are owned by or licensed to us and are protected by applicable intellectual-property laws.

You may view the website and retain order information for personal, non-commercial use. No other use, reproduction, adaptation, sale or distribution is permitted without prior written consent.

15. Reviews, Messages and Submitted Content

If you submit a review, photograph, comment or other content, you confirm that you have the right to submit it and that it is not unlawful, misleading, defamatory or infringing.

We will request permission before using identifiable customer-home photographs or similar customer content for marketing where permission is required.

16. Privacy

Our collection and use of personal information are governed by our Privacy Policy and applicable data-protection law.

We may process information reasonably required to operate the store, respond to enquiries, process payments, manufacture products, deliver orders, prevent fraud, provide customer support and meet legal obligations.

17. Liability

Nothing in these terms excludes or limits liability for gross negligence, fraud, wilful misconduct, death or personal injury caused by negligence, defective or unsafe goods, or any other liability that cannot lawfully be excluded.

To the extent permitted by law, African ART.site will not be responsible for indirect or consequential loss that was not reasonably foreseeable when the contract was formed.

18. Events Outside Our Reasonable Control

We are not responsible for delay or failure caused by events outside our reasonable control, including severe weather, fire, flood, infrastructure failure, industrial action, material shortages, transport disruption, civil unrest, governmental action or courier interruption.

We will take reasonable steps to reduce the effect of such an event and communicate a material delay.

19. Governing Law

These terms and transactions through the South African store are governed by the laws of the Republic of South Africa.

Customers retain any rights to approach a court, consumer commission, ombud or other competent authority available under applicable law.

20. Changes to These Terms

We may update these terms by publishing a revised version on this website. The terms in effect when an order is placed will generally apply to that order, unless a change is required by law or agreed with the customer.
